This Agreement can be used between two parties to settle a claim one party has against the other party. This form is only designed to release and discharge a party from a civil, not criminal, claim. By executing this Settlement and Release Agreement the "Releasing Party" gives up all claims and rights the Releasing Party holds against the other party, whether known or unknown, in exchange for a monetary payment or other consideration. Because the Releasing Party gives up all known and unknown claims against the other Party, this form should only be used if the Releasing Party is fully aware of his, her or its legal rights. (Unknown claims, for example, means that if, after settling, the claimant discovers new injuries which resulted from the accident, claimant is barred from recovering for those new injuries.)
