This lease may be used for any residential unit or structure, such as an apartment, a condominium, a house, or a duplex. It allows you to prepare a residential lease agreement for up to three tenants. This form enables you to create either a tenancy for years or a month-to-month tenancy. A "tenancy for years" covers a fixed period of time, which may or may not exceed one year. A month-to-month tenancy renews itself each month until it is terminated by either party.

Landlord's are advised to check a local landlord's association or real estate office for any local laws that might apply to their rental property. For example, some states allow a first and last month's rent plus a security deposit, whereas other states allow only a first month's rent plus a security deposit. Another example is the time in which the landlord must repay the security deposit. Some states allow 30 days, whereas other states allow only 14 days.

    Most landlords require tenants to provide a security deposit prior to taking occupancy of the premises. The landlord must return the security deposit to the tenant within a certain period of time after the lease is terminated, but can withhold amounts necessary and reasonable to cover damages caused to the premises by the renter in excess of ordinary "wear and tear", and also to cover standard cleaning costs.
