Revocation of Financial Durable Power of Attorney - Example Document
In this sample document, the Revocation of Financial Durable Power of Attorney is used to revoke a certain Financial Durable Power of Attorney, which is identified. A Revocation of Financial Durable Power of Attorney cancels the authoritization granted under the Financial Durable Power of Attorney.
Because a person may have signed more than one power of attorney at any given time, it is important to specifically identify the Power of Attorney being revoked. For example, a person may have a Durable Power of Attorney for Financial decisions and a Durable Power of Attorney for Health Care in effect, at the same time. Thus, this Revocation asks for the specific date the Durable Power of Attorney being revoked was signed, the place signed, (if applicable) recording information, etc.
Normally a Durable Power of Attorney remains in effect indefinitely, or until
the Principal revokes it for a specific purpose, such as the desire to change
the named agent, also known as the "Attorney-in-Fact", or to enlarge or restrict the
scope of such powers. Instead of "amending" or otherwise modifying an
existing Power of Attorney document, it is always better to revoke the
Power of Attorney and to replace it with a newly created Power of Attorney.
